In Minnesota, attorneys are not required in all real estate transactions.  However, considering that the sale or purchase of a home or business is the largest financial transaction that most people will ever make, it makes sense to contact a real estate attorney to ensure that your interests are protected.

If no real estate agent is involved in the transaction (for example, in a sale-by-owner transaction), both the buyer and the seller should hire an attorney who is familiar with the process and the legal documents to make sure their interests are protected.

When both buyer and seller have real estate agents, it’s still a good idea to hire a real estate attorney to perform specific functions, such as:

  • Reviewing purchase agreements before you sign it.  Once you sign a purchase agreement, it’s a binding legal contract.  In reviewing a purchase agreement, a real estate attorney may ask to have one or two things changed or added to protect your interests.  For example, if you need to add a contingency agreement to the purchase of a home or business, the agreement needs to be spelled out clearly and contain enough detail to prevent problems from cropping up later.  All issues, including which personal property stays with a property and which leaves with the previous owner, need to addressed clearly in the purchase agreement.

  • Resolving title issues, such as lost heirs (people who were not accounted for at time a property was probated), outstanding mortgages, liens and litigation attachments.   All title issues need to be resolved before the actual transfer of property can take place at the closing.
